All bookings are made with Dipaways, LLC. (us/we). By booking a trip with us you are deemed to have agreed to these terms and conditions (which constitutes the entire agreement between you and us) and your booking will be accepted by us on this basis. The services to be provided are those referred to in your booking confirmation.
This is valid from the time of your booking to the completion of your trip.
Acceptance of Booking
We will issue a confirmation receipt via email once your booking has been accepted. A contract will exist between us from the date we issue the confirmation receipt. If you book within 30 days of departure the contract will exist when we accept your payment.
All participants on our group trips must be over the age of 21. There are no age limits on our private trips. Please contact us if you have questions or concerns regarding the health or physical demands of our trips.
Your Personal Details
In order for us to confirm your participation, you must provide all requested details with the balance of the trip price. Necessary details vary by trip; they include but are not limited to full name, address, date of birth, phone number, email, nationality, proof of travel insurance, copy of passport, flight confirmations, and any medical conditions that may affect your ability to complete your trip. Some trips may require you to complete and forward a Self-Assessment form. Failure to provide the requested details may result in a non-refundable cancellation of your trip.
Inclusions and Exclusions
Our standard trips include:
- Accommodations as listed in the Trip Details
- Ground transport as listed in the Trip Details
- Activities and meals as listed in the Trip Details
- A trip host as described in the Trip Details
- A photographer as described in Trip Details
- Meals as listed in the Trip Details
The price of your trip does not include:
- International or domestic flights, unless otherwise specified
- Meals other than those specified in the Trip Details
- Visa and passport fees
- Travel insurance or supplementary health insurance
- Optional activities and all personal expenses
- Any other charges or fees during your trip
Payments are securely managed through Stripe by Dipaways.
Once you have placed your booking, an initial payment (your deposit) is required. Deposits are non-refundable and non-transferable. If your booking is made within 30 days of the departure date, the full amount is required at the time of booking. Subsequent automatic charges will occur at the time interval you select. If you wish to change a payment please let us know at least 48 hours prior to the scheduled payment. Otherwise, your card may be charged by our system.
If a payment is missed, we’ll notify you via email as a courtesy. If we don’t hear back before your next due date, an automatic recalculation occurs, at no additional fee. Future payments will increase to absorb the missed payment to ensure the final balance date remains the same. If 2 or more payments are missed, you will need to contact us to avoid auto-cancellation and to discuss a catch-up plan. Passport and Visas
You must have a valid passport and have obtained all of the appropriate visas, permits, and certificates for the countries which you will visit during your trip. Your passport must be valid for 6 months beyond the duration of the trip. It is your responsibility to ensure that you are in possession of the correct visas, permits, and certificates for your trip; please refer to the Trip Details for more information. We are not responsible if you are refused entry to a country because you lack the correct passport, visa, or other travel documentation.
Travel Health Insurance
Travel insurance is mandatory for all our participants and should be taken out at the time of booking. Your travel health insurance must provide cover against personal accident, death, medical expenses, and emergency repatriation. We also strongly recommend that it covers cancellation, curtailment, personal liability, and loss of luggage and personal effects. You must provide your travel insurance policy number and the insurance company’s 24-hour emergency contact number prior to your trip; you will not be able to join the trip without these details. If you have insurance connected to your credit card or bank account please ensure you have details of the participating insurer, the insurance policy number, and emergency contact number with you rather than the bank’s name and credit card details.
While we aim to operate all trips as described we reserve the right to change the trip itinerary. The itinerary provided for each trip is representative of the types of activities planned, but it is understood that the route, schedules, itineraries, amenities, and mode of transport may be subject to change without prior notice due to local circumstances or events. If we make a major change, we will inform you as soon as reasonably possible.
Authority on Trips
Our group trips are run by a Trip Host. The decision of the Trip Host is final on all matters likely to affect the safety or well-being of any participant or team member participating in the trip. If you fail to comply with a decision made by a host or interfere with the well-being or mobility of the group, the host may direct you to leave the trip immediately, with no right of refund. We may also elect not to carry you on any future trips booked. You must at all times comply with the laws, customs, foreign exchange and drug regulations of all countries visited, and you also agree to travel in accordance with our responsible travel guidelines.
Acceptance of Risks
You acknowledge that the nature of the trip is adventurous and participation involves a degree of personal risk. You will be visiting places where the political, cultural, and geographical attributes may present dangers and physical challenges greater than those present in our daily lives. We use information from government foreign departments and reports from our own contacts in assessing whether the itinerary should operate. However, it is also your own responsibility to acquaint yourself with all relevant travel information and the nature of your itinerary. You acknowledge that your decision to travel is made in light of consideration of this information and you accept that you are aware of the personal risks attendant upon such travel.
Limitation of Liability
We contract with a network of companies, agencies, and individuals to assist in the running of our trips. We are not responsible for the acts and omissions of these third parties.
To the fullest extent permitted by law:
Any liability for any loss, death, injury or damage which you may suffer (directly or indirectly) in connection with or as a result of your participation in a trip, or any breach of the Terms, are excluded; You release us and our employees, agents, and representatives from any liability and expressly waive any claims you may have against us arising out of or in connection with your participation in a trip; Any condition or warranty which would otherwise be implied by law into these Terms (Implied Warranty), is excluded.
To the extent an Implied Warranty cannot be excluded, our liability in respect of the Implied Warranty is limited to (in our absolute discretion): (i) the provision of a similar trip to an equivalent value; or (ii) a refund of the total amount received by us from you in connection with your booking.
Any claim by you is excluded to the extent that it is for indirect or consequential loss, loss of profits or economic loss, however it arises, or for indirect, special, punitive, or exemplary damages.
Optional activities not included in the trip price do not form part of the trip or this agreement. You accept that any assistance given by your trip host or local representative in arranging optional activities does not render us liable for them in any way. The contract for the provision of that activity will be between you and the activity provider.
You may be able to switch from one trip to another departing within 12 months or transfer your booking to a different person. Simply notify us at least 60 days before your original departure date. In some cases, trip operating costs or charges levied by our local partners may be deducted from your balance. Any changes after 60 days of booking will include a fee of $150 per person. Transfers to another person are only permitted where the transferee meets all the requirements in relation to the trip, and transfers to another departure can only be made to a departure within the current validity period (6 months from the original departure date). No changes are permitted to your booking within 30 days of departure.
Cancellations by you
COVID-19: Any traveler who books before March 31, 2021, may cancel and request a full trip credit OR cancel and request a trip refund (minus the non-refundable deposit), up to 30 days before your trip’s start date. This applies to COVID-19 related cancellations only. If you or an immediate family member are sick or unable to travel as a direct result of a COVID-19 infection, this is covered under our refund policy. Verifiable documents that show you’re unable to travel because of COVID-19 will be required. Due to the unique nature of the pandemic, each request will be reviewed on a case-by-case basis. Any other cancellations by you will be governed by our standard cancellation terms.
If you cancel within 24 hours of booking a full refund will be issued, minus the non-refundable deposit. A cancellation will only be effective when we receive a written confirmation via email or a request on dipaways.com. Deposits are non-refundable and non-transferable. After 24 hours we will retain 100% paid by you. Deposits are non-refundable and non-transferable. If you fail to join a trip, join it after departure, or leave it prior to its completion, no refund will be made. The above cancellation fees are in addition to fees that may be levied by accommodation providers, travel agents, or third party tour and transport operator fees. You are strongly advised to take out “cancel for any reason” cancellation insurance at the time of booking. This could help recover any losses.
Cancellation by us
We may cancel a trip at any time prior to departure, due to natural disasters, terrorism, political instability, or other external events that make it no longer viable to operate the planned itinerary. If your trip is canceled, we will notify you immediately and provide instructions for the next steps. In circumstances where the cancellation is due to external events outside our reasonable control, refunds will be less any unrecoverable costs. We are not responsible for any incidental expenses that you may have incurred as a result of your booking including but not limited to visas, vaccinations, travel insurance, or non-refundable flights. Please note that different cancellation conditions may apply to some styles of trips; we will advise if differences apply. To help you recover any losses, we strongly advise you to purchase “cancel for any reason” cancellation insurance at the time of booking.
In the event that any term or condition contained in these terms and conditions is unenforceable or void by operation of law or as being against public policy or for any other reason, then such term or condition shall be deemed to be severed from this contract or amended accordingly only to such extent necessary to allow all remaining terms and conditions to survive and continue as binding.
Photos and Marketing
By purchasing and/or participating on a trip, you consent to the use of any images taken for advertising and promotional purposes in any medium we choose. You grant us a perpetual, royalty-free, worldwide, irrevocable license to use such images for publicity and promotional purposes.
The laws of California govern these terms and conditions to the fullest extent allowable. Any disputes in connection with a trip or these Terms must be initiated in the courts of California.
